REQUEST, ISSUES, BOARD TYPE, AND DECISION: The applicant requests an upgrade of general (under honorable conditions) discharge to honorable. The applicant seeks relief contending, in effect, that the applicant enlisted in the Army Air National Guard as a prior service veteran, with an honorable discharge from the Air Force Active Duty having served 4 years and an Honorable Discharge from the Tennessee Air National Guard as well after serving 6 years. The applicant's short disheartening experience in the Tennessee Army Air National Guard in Memphis, TN broke the applicant's heart and spirit. The cruel demeaning behavior that the applicant was subjected to by four males superiors, presented such a hostile environment. The applicant just felt loss at the time and with being new to the unit felt there wasn't any one to turn to for support and knew the military career would forever be changed from that moment. For years the applicant blamed herself, but not anymore. The applicant had been in the military since 18, served, went to school and obtained a degree and just wanted to keep serving. The applicant just wanted to serve and do what the military teaches. Per the Board's Medical Officer and based on the information available for review at the time in the service record, the Armed Forces Health Longitudinal Technology Application (AHLTA), and Joint Legacy Viewer (JLV) were reviewed. JLV indicates the applicant has been diagnosed with the following BH conditions by the VA: Panic Disorder, Generalized Anxiety Disorder, Alcohol Use Disorder, Cannabis Use Disorder and history of Major Depressive Disorder. As the basis for separation is not known, no statement regarding medical mitigation can be made. REGULATORY CITATION(S): Army Regulation 135-175 sets forth the basic authority for the separation of officers from the U.S. Army Reserve (USAR), except for officers serving on active duty or active duty training exceeding 90 days. Specific categories include substandard performance of duty, moral or professional dereliction, in the interest of national security, as a result of trial by court martial, a pattern of misconduct, and commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without proper authority from unit training. Army policy states that an under other than honorable conditions discharge is normally considered appropriate; however, a general under honorable conditions or an honorable discharge may be granted. 8. DISCUSSION OF FACT(S): The applicant requests an upgrade of her general (under honorable conditions) discharge to honorable. The applicant's available record of service, the issues and documents submitted with her application were carefully reviewed. The applicant's record is void of the specific facts and circumstances concerning the events which led to the former Soldier's discharge from the US Army Reserve. However, the record shows that on 28 July 2008, DA, HQS, U.S. Army Reserve Command, Fort McPherson, GA, Orders 08-210-00015, discharged the applicant from the US Army Reserve, effective 27 August 2008, with a general (under honorable conditions) discharge. Barring evidence to the contrary, the presumption of government regularity shall prevail, as all the requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process.
