The applicant's DD Form 214, reflects she was not transferred to the USAR Control Group and she did not have a Reserve Obligation Termination Date. Service School Academic Evaluation Report, dated 30 August 2013, reflects the applicant was released from the Drill Sergeant School Program, in part, for failing to lead by example and discredited the Corps of the Noncommissioned Officer by blatantly altering the HRC DSS Commanders Checklist in order to hide the negative remarks left by her Company Commander. Her disregard for the Army Core Value integrity is unacceptable. The applicant lacked the self- discipline and sense of integrity required to perform as Drill Sergeant or any leader in the Initial Training Environment. It was strongly recommended that she be prevented from being around any Soldier participating in Initial Military Training. The recommendation was that the applicant be removed from the Drill Sergeant School Program. On or about 29 August 2013, prior to beginning training at the Drill Sergeant School at Fort Jackson, she wrongfully altered Drill Sergeant School application documents. Without authorization and with intent to deceive, she used white-out to cover up unfavorable comments from her company commander that were written on the Unit Commander's Checklist as part of her application to become a drill sergeant. POST SERVICE ACCOMPLISHMENTS: The applicant states, she has earned her Associate's Degree and certifications in Lean Six Sigma Green Belt, Project Management Professional (PMP), Society for Human Resources Management (SHRM), and Microsoft Certified Professional (MCP). 7. REGULATORY CITATION(S): Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 19 contains policies and procedures for voluntary and involuntary separation, for the convenience of the Government, of RA NCOs and USAR NCOs serving in AGR status, under the QMP. NCOs whose performance, conduct, and/or potential for advancement do not meet Army standards, as determined by the approved recommendations of HQDA centralized selection boards responsible for QMP screening, will be denied continued service. Paragraph 19-12 applies to Soldiers who choose not to appeal the QMP selection for denial of continued service, or whose appeal is denied, will be involuntarily discharged. Soldiers who elect to appeal but fail, without compelling justification, to submit the appeal within the time prescribed by paragraph 19-11b, will also be involuntarily discharged. Army policy states the service of personnel separated under this paragraph will be characterized as honorable. Army Regulation 635-5-1 (Separation Program Designator (SPD) Codes) provides the specific authorities (regulatory or directive), reasons for separating Soldiers from active duty, and the SPD codes to be entered on the DD Form 214. DISCUSSION OF FACT(S): The applicant requests a reentry eligibility (RE) code change. The applicant's available record of service, the issues and documents submitted with her application were carefully reviewed. The applicant's record is void of the specific facts and circumstances concerning the events which led to her discharge from the Army. However, the applicant's record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicant's signature. The DD Form 214 indicates the applicant was discharged under the provisions of AR 635-200, Chapter 4, by reason of Non-Retention on Active Duty, with a characterization of service of Honorable, with Separation Code of "JGH". Barring evidence to the contrary, it appears that all requirements of law and regulation were met and the rights of the applicant would have been protected throughout the separation process. Army Regulation 635-5-1 (Separation Program Designator (SPD) Codes provides the specific authorities (regulatory or directive), reasons for separating Soldiers from active duty, and the SPD codes to be entered on the DD Form 214. It identifies the SPD code of "JGH" as the appropriate code to assign enlisted Soldiers who are discharged under the provisions of Army Regulation 635-200, Chapter 19, paragraph 19-12, non-retention on active duty. The regulation further stipulated no deviation is authorized. Further, the Soldier will be assigned an RE Code of 4. The applicant desires to rejoin the Military Service. However, Soldiers being processed for separation are assigned reentry codes based on their service records or the reason for discharge. Based on Army Regulation 635-5-1 and the SPD Code/RE Code Cross Reference Table, the applicant was appropriately assigned an RE code of 4. An RE code of 4 cannot be waived and the applicant is no longer eligible for reenlistment. The service record reflects someone in the discharge process erroneously entered on the applicant's DD Form 214, block 25, separation authority as AR 635-200, Chapter 4. Army Regulation 635-5-1 (Separation Program Designator (SPD) Codes) list the separation authority as AR 635-200, paragraph 19-12 for Soldiers involuntarily separated for the reason of non- retention on active duty. The applicant contends the event that caused her discharge from the Army was an isolated incident. Although a single incident, the discrediting entry constituted a departure from the standards of conduct expected of Soldiers in the Army. Army Regulation 635-200, in pertinent part, stipulates there are circumstances in which the conduct or performance of duty reflected by a single incident provides the basis for separation. The Army Discharge Review Board is authorized to consider post-service factors in the recharacterization of a discharge. However, there is no law or regulation which provides an unfavorable discharge may be upgraded based solely on the passage of time or good conduct in civilian life subsequent to leaving the service. Outstanding post-service conduct, to the extent such matters provide a basis for a more thorough understanding of the applicant's performance and conduct during the period of service under review, is considered during Board proceedings. The Board reviews each discharge on a case-by-case basis to determine if post-service accomplishments help demonstrate previous in-service misconduct was an aberration and not indicative of the member's overall character. The applicant contends that an upgrade of her discharge will allow her to obtain better employment. However, the Board does not grant relief for the purpose of gaining employment or enhancing employment opportunities. Notwithstanding the administrative errors, based on the available record, the discharge was consistent with the procedural and substantive requirements of the regulation, was within the discretion of the separation authority and that the applicant was provided full administrative due process. 9.
