Report of Mental Status Evaluation, dated 14 December 2016, which noted that the applicant could understand and participate in administrative proceedings and appreciated the difference between right and wrong. The applicant was seen for a Chapter 13 mental status examination for failure of two record APFT's. The applicant's electronic medical records were reviewed for BH treatment and diagnosis. He had no history of BH treatment and declined any further services from 101 AVN BH at the time. The applicant was screened for PTSD and m-TBI IAW OTSG/MEDCOM policy memo 10-040 (findings were negative for both PTSD and m-TBI). His thoughts were logical, linear and goal oriented. He exhibited no delusions, paranoia or other psychotic symptoms. The applicant met medical retention requirements IAW AR 40-501 and was therefore cleared for administrative separation under Chapter 13. REGULATORY CITATION(S): Army Regulation 635-200 sets forth the requirements and procedures for administrative discharge of enlisted personnel. Chapter 13-2e states in pertinent part, that separation proceedings will be initiated for Soldiers without medical limitations that have two consecutive failures of the Army Physical Fitness Test. The reason for discharge will be shown as physical standards. The service of Soldiers separated because of unsatisfactory performance for failure to meet physical standards will be characterized as honorable or general (under honorable conditions). 8. DISCUSSION OF FACT(S): The applicant requests an upgrade of his general (under honorable conditions) discharge to honorable. The applicant's record of service, the issues and documents submitted with his application were carefully reviewed. The applicant seeks relief contending that he served honorably during his career as a Soldier and deserves an honorable discharge. The record confirms that the applicant's discharge was appropriate because of unsatisfactory performance which diminished the quality of his service. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that the applicant's service mitigated the misconduct or poor duty performance. Also the record does not contain any indication or evidence of arbitrary or capricious actions by the command and all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The character of the applicant's discharge is commensurate with his overall service record. The discharge was consistent with the procedural and substantive requirements of the regulation, was within the discretion of the separation authority, and the applicant was provided full administrative due process. 9.
