Disciplinary Action(s) / Evidentiary Record: Report of Mental Status Evaluation, dated 15 May 2017, revealed the applicant screened negative for TBI and PTSD. There was no psychiatric disease or defect that warrants disposition through medical channels in accordance with AR 40-501, Standards of Medical Fitness. He was mentally sound and able to appreciate any wrongfulness in his conduct and to conform his conduct to the requirements of the law. He was considered accountable for his actions. He had the mental capacity to understand and participate in board proceedings. He was psychiatrically cleared for any administrative action deemed appropriate by command. The applicant received several negative counseling statements regarding his PT test failures; being enrolled in the Army Body Composition Program (ABCP); social media activity and postings; and failing to meet financial obligation to his spouse. i. POST SERVICE ACCOMPLISHMENTS: None submitted with the application. 7. REGULATORY CITATION(S): Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this Chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and / or become a satisfactory Soldier. Army policy states that a general, under honorable conditions discharge is normally considered appropriate; however, an honorable discharge may be granted in meritorious cases. 8. DISCUSSION OF FACT(S): The applicant requests an upgrade of the characterization of service from general (under honorable conditions) to honorable. The applicant's record of service, the issues and documents submitted with his application were carefully reviewed. The record confirms that the applicant's discharge was appropriate because of unsatisfactory performance which diminished the quality of his service below that meriting an honorable discharge at the time of separation. The applicant provided no independent corroborating evidence demonstrating either the command's action was erroneous or the applicant's service mitigated the duty performance, such that he should have been retained on Active Duty. The applicant seeks relief contending, he failed the PT test because he was unable to properly breathe because he developed asthma while in the Army; and because of the two conditions, asthma and his leg injury prevented him from being able pass the PT test. The service record does not support the applicant's contentions, and no evidence to support it has been submitted to corroborate the discharge was the result of any medical condition. Further, the record does not contain any medical evidence to indicate a problem which would have rendered the applicant disqualified for further military service with either medical limitation or medication. The independent medical and VA documents submitted by are acknowledged. The applicant further contends, he was in the process of getting necessary medical exams to explain / prove his condition, but before he was allowed to present his case, leadership proceed with separation action. The record does not contain any indication or evidence of arbitrary or capricious actions by the command and all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The applicant also contends, he feels that if he was given time to get the proper medical attention and necessary paperwork explaining his conditions, he would not have been discharged. The rationale the applicant provided as the basis for what he believes was an unfair discharge is not supportable by the evidence contained in the record and can only be viewed as speculative in nature. The discharge was consistent with the procedural and substantive requirements of the regulation, was within the discretion of the separation authority, and the applicant was provided full administrative due process. 9.
