The applicant's complete Personnel Data Record and Separation Package were available for the Board to review. The Board also utilized available information contained in electronic records and documents submitted by the applicant. The applicant was involved in two alcohol incidents in 2006 that involved simple assault and disorderly conduct. Both occurrences were documented in which they indicated that alcohol was a causative factor. The applicant was subsequently granted a Second Chance Waiver to continue serving after the command had recommended the applicant for discharge. In the Spring of 2010, the member was counseled on alcohol use due to tardiness in unit activities. In late 2010, while on deployment, it was determined that the applicant urinated in the back of a rental vehicle procured with government funds. The applicant was then taken to NJP in the Spring of 2011 and recommended for discharge. The right to an attorney, and to make a statement were afforded; The applicant objected to the discharge and made a short statement. The Board finds no issues with propriety or equity in this case.
