DRB DIGEST/EXECUTIVE SUMMARY DRB DOCKET 2013- 041 NAME CURRENT DD-214 General, COMDTNST MIOOO.6A, JKK, Misconduct, RE4 RELIEF REQUESTED Upgrade RE code RELIEF GRANTED BY DRB Partial Relief to Under Honorable Conditions per post-policy ALCOAST 562/08 ADMIN CORRECTIONS None TIS 0 yrs, 11 months, 7 days Policy Implications None EXECUTIVE SUMMARY: The applicant was discharged for Misconduct due to Involvement with Drugs. The applicant had a positive urinalysis result for methamphetamines in the late summer of 2005. In the application, the applicant denies any usage or wrongdoing with drugs. A mention was made by the applicant that he wanted to do a follow up urinalysis test to prove his innocence. In late 2005, the applicant was taken to NJP where he pled guilty and received punishment. The applicant was given an opportunity to state their case, but chose not to provide a statement. In the Spring of 2006, the Discharge was approved. The Board finds no issues with propriety or equity in this case. Coast Guard policy prescribes no higher than an Under Honorable Conditions character of service for individuals separated as a result of violating the Coast Guard's drug policy. The Board notes a General Discharge was issued. Per post policy noted in ALCOAST 562/08, a General discharge is no longer considered an official character of service. Therefore, the board recommends a partial upgrade to an Under Honorable Conditions character of service. All other items remain the same. Final Adjudication by Assistant Commandant For Human Resources: Partial Relief is granted to Under Honorable Conditions per post-policy ALCOAST 562/08. All other items stand as issued.
