EXECUTIVE SUMMARY: The applicant was discharged for Alcohol Rehabilitation Failure due to receiving two alcohol incidents in 2008-2009. With regard to the Narrative Reason for Separation, the applicant had previously been to outpatient treatment in 2007 for a self-referral. In the Spring of 2008, the applicant received the first alcohol incident for a physical and verbal altercation with patrons at a bar, provoking shipmates, and entering another shipmate's bed without consent. Due to the applicant's 2007 completion of outpatient treatment, they were not sent back to treatment after the incident was documented. Thereafter in the Fall of 2009, the applicant was charged with for driving under the influence and having open containers of alcohol in a vehicle. In early 2010, the applicant was documented for the second alcohol incident and processed for discharge. After the command's notification to Discharge, the applicant provided a statement to state the desire to remain in the service. The statement had no evidence to absolve or refute the second incident. The applicant did not dispute the command's findings-- just asked for consideration to be retained. Whereas, the current board application states being wrongly accused and was still processed for discharge. The Board finds that the applicant's intent in the 2009 alcohol incident is consistent with the propriety standard of the discharge issued. On the equity standard, the board referred to ALCOAST 125/10 released on March 18, 2010 (member discharged shortly after), to make a recommendation on the Narrative Reason (NR) for Separation. The Board notes most or all separations occurring after said ALCOAST to the present, only issue a JPD (SPD) code when the member is unable to complete outpatient treatment, or they refuse altogether.
