The SPD code of JPD issued with the Discharge is for personnel who fail to complete an Alcohol treatment program, or refuse the program altogether. This administrative error was in the applicant's favor. After receiving two documented alcohol incidents in the Fall of 2004, an administrative remarks entry was documented in which the applicant refused to attend outpatient rehabilitation treatment for Level Il Alcohol Abuse. The applicant claims that on the night of the second alcohol incident, the breathalyzer test showed 0.00, therefore alcohol was not a causative factor. The applicant forwarded a print out from the Police Department within the current application. The board does question the validity of the document as it has no civil-law notary endorsement, nor does it represent an official public document issued from the Police Department. Additionally, the applicant did not object to the discharge in 2004. The Board has reviewed the service record of the applicant. In addition to the disputed 2nd alcohol incident, the applicant had a laundry list of insubordination, performance issues, hostility toward others, a lack of integrity and mental instability, the Board recommends use of the Legacy Personnel Manual, Article 12-B-12-f as follows: Discharge for Other Reasons If the commanding officer believes separation should not be for the convenience of the Government, but for unsuitability, misconduct, or any other reason, he or she will send a suitable recommendation to Commander (CGPC-epm-l) for consideration.
