The applicant was retained in the service after documented incidents (over the previous 5 years) in 2008. This waiver was under the condition that to abstain from alcohol for the rest of the applicant's career as acknowledged in a 2008 administrative remarks entry. Thereafter, the applicant was taken to mast for violating this order in late 2008. The command initiated discharge proceedings following the Non-Judicial punishment (NJP). The applicant was notified of the intent to discharge, and the applicant was advised of the rights to an attorney. The applicant declined to make a statement and did not object to discharge. The Board notes that the applicant was granted retention in the service in the Spring of May 2008 after the command recommended an Unsuitability Discharge. Thereafter, the applicant failed to meet the conditions set forth for his continued employment with the service. The applicant failed to abstain from alcohol in the Fall of 2008. Therefore, the applicant failed to meet the documented future conditions of employment, which upholds the Narrative Reason as issued. No relief. Final Adjudication by Assistant Commandant For Human Resources: No relief.
