The first incident occurred in 2011 when the applicant was drinking underage and passed out in the passageway of the vessel due to excessive consumption. Additionally, the applicant obtained the beverages by way of using fake identification. Thereafter in 2013, the applicant entered a nolo plea after being cited for a DUI. The applicant has since provided the Board with civil court documents indicating the Final Adjudication was reduced to reckless driving. Based on the Discharge documents in the applicant's record, the BAC reading in the second incident shows that alcohol was a causative factor. The Board finds no issues with propriety or equity in this case. A preponderance of the evidence was considered prior to the Discharge and no new evidence finds that the incidents were in error. The applicant was notified of the intent to discharge, and the applicant was advised of the right to an attorney. A statement was made while objecting to discharge.
