The applicant received an alcohol incident in the Fall of 2008 for underage drinking. Thereafter, the applicant was convicted of a DUI in 2009, and then just a few months later being an intoxicated passenger in a separate incident in which the applicant was detained. The applicant did complete treatment after the first and second incidents, but not after the last incident. In an administrative remarks entry, the applicant elected to decline treatment for the last ii:icident. Therefore, the applicant was issued the Alcohol Rehabilitation Failure as the Narrative Reason for Separation due to the refusal for treatment. - The Board finds no issues with propriety or equity in this case. The applicant was notified of the intent to discharge, and the applicant was advised of the rights to an attorney. The applicant declined to make a statement and did not object to discharge.
