The Discharge stemmed from Unsuitability in which the applicant accumulating two alcohol incidents in the short time in service, occurring between 2012-2014. The applicant was subject to a Coast Guard Investigative Service report of investigation in 2012 due to a domestic incident in which alcohol was a causative factor. The report shows that sexual advances and battery were plausible actions provided by the applicant's (Coast Guard mbr) roommate that could have also taken place, but the other civilian party chose not to follow through with agents for official testimony and evidence. In 2014, the applicant was involved in an assault at a bar that resulted in a civil arrest. The incident also showed alcohol to be causative factor. The applicant has provided items to show the establishment (site of incident) to be an unlawful and rowdy in which the applicant was harassed and assaulted by the security staff. The Board looks to the preponderance of the evidence within the Discharge package processed by the applicant's command. The Board also notes the applicant did NOT ask for a Second Chance waiver to be retained in the service. The Board finds no issues with propriety or equity in this case. The applicant was notified of the intent to discharge, and the applicant was advised of the rights to an attorney. The applicant made a statement and objected to the discharge. Propriety: Discharge was proper. Equity: Discharge was equitable. Final Adjudication by Assistant Commandant for Human Resources: No relief.
