The applicant waived the right to an Administrative Separation Board and requested an Other Than Honorable discharge in lieu of further military justice proceedings (which could have ultimately resulted in a Dishonorable discharge). The applicant is serving a current prison term that was awarded by a US District Court. The applicant pled guilty to prolonged and extensive theft of property and funds. The Board finds no issues with propriety or equity in this case. The applicant requested the discharge to avoid the maximum UCMJ punishment. The applicant received the most favorable character of service possible. RECOMMENDATION: The Board members thoroughly reviewed the applicant’s record of service and all available documentation. The Board deemed that the applicant’s character of service, reason for separation and reenlistment code are appropriate and should not be changed. The applicant has not substantiated any error or inequity. 2 In reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence (to include evidence submitted by the Applicant) to rebut the presumption.
