The applicant was facing a Special Board action for infractions cited by subordinates and their chain of command. In lieu of Board action and possible punishment, the applicant chose to voluntarily retire to avoid the proceedings. The applicant had also pleaded no contest to misdemeanor assault and battery. The Board has no issues with propriety or equity in this case. The applicant requested retirement under these terms which was granted with no further proceedings or punishment. The applicant received an Honorable character of service upon retirement. No new evidence has been provided by the applicant. RECOMMENDATION: The Board members thoroughly reviewed the applicant’s record of service and all available documentation. The Board deemed that the applicant’s character of service and reason for separation should not be changed.
