The applicant assaulted another shipmate while being heavily intoxicated. The applicant came to work intoxicated and was also taken to NJP for driving under the influence. The Board does note there is no record of substance abuse treatment in the applicant’s record. The Board has no issues on the propriety standard of this discharge. On the equity standard, the board referred to post-policy of ALCOAST 125/10 to make a recommendation on the Narrative Reason (NR) for the discharge. The Board notes most or all separations occurring after the release of said ALCOAST to the present, only issue a JPD (SPD) code when the member is unable to complete outpatient treatment, or an objection or refusal for treatment altogether is documented. Neither of those actions occurred in this case. Therefore, the Board recommends that the NR be amended to: Separation for Miscellaneous/General Reasons with a Separation Type of: (Unsuitability) Alcohol Abuse. The recommended SPD code is JND. RECOMMENDATION: The Board members thoroughly reviewed the applicant’s record of service and all available documentation. 2 In reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence (to include evidence submitted by the Applicant) to rebut the presumption.
