The Applicant was found guilty of being absent without leave and making false official statements. The Board carefully reviewed the investigation of said charges and heard verbal testimony from the applicant. Over a 15 month period, the applicant did not properly submit leave transactions into the Direct Access database (to officially account) for absences totaling 59 days. This was in direct violation of the command instruction in which leave must be submitted for all absences that are not considered liberty or federal holidays. The Board finds that the applicant willingly shirked their duties by removing themselves from the appointed place of duty repeatedly without following the Command regulations. This premeditated inaction and failure of compliance unnecessarily forced several days and hours of watchstander duty onto fellow shipmates over the prolonged period. The Board finds no issues with propriety or equity in this case. The applicant was notified of the intent to discharge, and the applicant was advised of the right to an attorney. The applicant did not object to the discharge. Propriety: Discharge was proper. Equity: Discharge was equitable. Final Adjudication By Assistant Commandant for Human Resources: Concur with Board.
