The basis for his discharge was failure to successfully complete his six-month probationary period. Over a oneyear period, he demonstrated the inability to overcome his documented deficiencies in behavior and conduct, and not complete the conditions set forth in his probation period. The Board finds no issues with propriety or equity in this case. The Board carefully reviewed the current petition and finds no error of fact on the basis to separate the Applicant from the service. Despite the unacceptable behavior, the Board does not recommend a partial upgrade to reflect that the Applicant’s troubles were from a hardship or performance-laden. The majority opinion (3-2) among the panel is that the discharge to stand as issued. Minority Board voted 2-3 that the totality of service is best characterized as “Unsatisfactory Performance”. The Applicant was notified of the intent to discharge, and was advised of his rights to an attorney, and made a statement on his behalf. Propriety: Discharge was proper.
