In March 2012, he received two Non-Judicial Punishment (NJP) Proceedings. On 05 Mar 2012, applicant was found guilty of unauthorized absence, insubordinate conduct towards a Petty Officer, and not keeping with good order and discipline in the Armed Forces. On 18 Mar 2012, applicant was found guilty of failure to obey and order or regulation when he failed to follow the procedure in accordance with his restriction memorandum applicant received during his 05 Mar 2012 NJP proceeding. The Applicant also received two additional NJP proceedings, one in March 2009 and the other in November 2007. The Applicant’s service record has displayed a blatant disregard for Coast Guard Core Values and military lifestyle. The Board finds no issues with propriety or equity in this case. The applicant was notified of the intent to discharge, and the applicant was advised of the right to an attorney. The applicant waived his right to submit a statement, and did not object to the discharge. RECOMMENDATION: The Board members thoroughly reviewed the applicant’s record of service and all available documentation. The Board deemed that the applicant’s reason for separation and reenlistment code are appropriate and should not be changed. The applicant has not substantiated any error or inequity. Propriety: Discharge was proper. Equity: Discharge was equitable. Board Conclusion: The Board voted 5-0 to recommend no relief.
