The Applicant’s Character of Service is Under Honorable Conditions and the Narrative Reason is Misconduct. The reason for the Applicant’s discharge was due to violating Article 134, Unlawful Entry. This was deemed Commission of a Serious Offense and investigated by CGIS. The Applicant entered the residence of their ex-girlfriend without permission and remained after being told to leave. The Applicant was also charged with one (1) count of Computer Trespass 2nd Degree which was investigated by CGIS. The Applicant unlawfully entered the victim’s email account without permission and sent an email to the victim’s professor. The Applicant was issued a No Contact Order and entered into count of Computer Trespass. During the next year, the Applicant received three (3) negative CG-3307s. The Applicant did not present any evidence or information which would warrant a change to their Characterization or Narrative Reason for Separation. 2 In reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence (to include evidence submitted by the Applicant) to rebut the presumption.
