The Applicant’s Character of Service is Under Other Than Honorable Conditions and the Narrative Reason for Separation is Triable By Court Martial. The reason for the applicant’s separation was due to several violations of the UCMJ. The applicant was charged with, and admitted to violation of Article 107 (False Statements), Article 128 (Assault) and Article 134 (Good Order / Discipline). The Board discussed the CGIS investigation presented which was used as the basis of the applicant’s discharge. The applicant voluntarily signed their court memorandum acknowledging their possible discharge and waived their right to an Administrative Discharge Board. The Board has no issues with the propriety standard on this case. RECOMMENDATION: The Board members thoroughly reviewed the applicant’s record of service and all available documentation. 2 In reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence (to include evidence submitted by the Applicant) to rebut the presumption.
