In accordance with COMDTINST M1000.2 (series), the applicant was not authorized to re-enlist because the applicant did not meet the basic eligibility requirements when the applicant was involved in drug incident in September 2015. Therefore, the applicant did not receive a positive recommendation for reenlistment/extension. The Military Separations manual (COMDTINST M1000.4 (series) states that members who have eight or more years of total active duty and do not meet the reenlistment eligibility criteria are not entitled to a reenlistment board and must be processed for separation. The Board finds no issues with propriety or equity in this case. The applicant was notified of the involuntary separation, and the applicant was advised of the right to an attorney. The applicant waived his right to submit a statement at the time with the option to submit a statement another time. Propriety: Discharge was proper. Equity: Discharge was equitable.
