The Board thoroughly reviewed all of the documentation including the applicant's statement. The PDR contains 3307s documenting a failure to obey orders and altering recipes that were provided to cook meals for the crew. The Board examined the PDR and acknowledged the lack of an EER depicting misconduct or other significant disciplinary action taken. The separation authority listed on the DD-214 is COMDTINST Ml000.6A, Art. 12.D.3. The SPD handbook prescribes an RE Code ofRE-3 or RE-4 for an SPD Code ofKDB. There was not a separation authorization available in Direct Access. PROPRIETY: The Board finds no issues with propriety in this case. The applicant was properly discharged under policy in effect at the time of discharge. EQUITY: The Board found an issue with equity in this case. The applicant was not properly processed under the policy that was in effect at the time of the discharge. RECOMMENDATION: The Board members thoroughly reviewed the applicant's record of service and all available documentation. The Board deemed that the applicant's character of service, reason for separation and reenlistment code are appropriate based on the available evidence and should not be changed. The applicant has substantiated any error or inequity. The Board deemed that the applicant's Reentry code should be up graded to an RE-3. Propriety: Discharge was proper. Equity: Discharge was not equitable. Board Conclusion: recommend relief of Block 27, the RE code, changing it from an RE-4 to an RE-3 which corresponds with the SPD Code KBD. 2 In reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence (to include evidence submitted by the Applicant) to rebut the presumption.
