This is in reference to your application for correction of your naval record pursuant to the provisions of 10 USC 1552 . Your case was reconsidered in accordance with Board for Correction of Naval Records procedures that conform to Lipsman v. Secretary of the Army, 335 F. Supp. 2d 48 (D.D. C. 2004). You previously petitioned the Board for a di sability discharge and were denied relief on 13 January 2010 and 22 April 2015. 

Your current application was reviewed for new and material evidence not previously considered by the Board. · You provided a personal statement reiterating your denial of misconduct that was related to non-judicial punishments that you received. ·In addition, you also raised the same arguments regarding your ongoing struggles you're your hepatitis condition. As you are aware, this evidence was previously considered by the Board and is not considered new and material evidence. Accordingly, your request for reconsideration is denied and your case is hereby administratively closed. 

It is .regrettable that the circumstances of your case are such that the Board will not process any additional reviews and this matter is considered a final agency action. However, if you wish to continue to seek relief you will need to present your concerns to a court of appropriate jurisdiction.
