Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show the Petitioner elected to sell accrued leave. 2. The Board, consisting of , reviewed Petitioner' s allegations of error and injustice on 14 October 2016 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence ofrecord. Documentary material considered by the Board consisted of the enclosures, naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an injustice warranting the following corrective action. RECOMMENDATION : That Petitioner's naval record be corrected, where appropriate, to show that: a. Petitioner's request to sell 60 days of accrued leave was approved by cognizant authority. Note: on 10 June 2015 Petitioner executed an Administrative Remarks (NA VPERS 1070/613), via his reenlistment effective 10 June 2015, certifying a leave settlement election of a cash settlement for 60 days leave. b. This change will entitle the member to a Lump-Sum Payment for Accrued Leave of 60.0 days. Note: Petitioner's leave balance will be reduced by 60 days, and he will be entitled to payment for 60 days of leave. c. A copy of this Report of Proce~dings will be filed in Petitioner' s naval record. 4.
