Pursuant to the provisions ofreference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to authorize an advancement. 2. The Board, consisting of , reviewed Petitioner's and allegations oferror and injustice on 6 June 2016 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence ofrecord. Documentary material considered by the Board consisted ofthe enclosures, naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department ofthe Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner's application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration ofall the evidence ofrecord, and especially in light ofthe contents ofenclosure (2), the Board finds the existence ofan injustice warranting the following corrective action. RECOMMENDATION: That Petitioner's naval record be corrected, where appropriate, to show that: a. Petitioner was advanced to E4 effective 16 April 2013. Note: Petitioner was advanced prior to his discharge on 25 April 2013. b. Note: Petitioner is due all pay and allowances at the E4 rate vice E3 from 16 April 2013 to 25 April 2013. c. Note: A DD Form 215, Correction to DD Form 214, has been placed in the Petitioner's Official Military Personnel File (OMPF). The DD Form 215 modified the Petitioner's paygrade at the time ofdischarge. d. A copy ofthis Report of Proceedings will be filed in Petitioner's naval record. 4. It is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record ofthe Board's proceedings in the above entitled matter. 5. Pursuant to the delegation ofauthority set out in Secti~sedProcedures ofthe Board for Correction of Naval Records (32 Code ofFederal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority ofreference (a), has been approved by the Board on behalf of the Secretary ofthe Navy.
