A three-member panel ofthe Board for Correction ofNaval Records, sitting in executive session, considered your application on 12 October 2016. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings ofthis Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, your naval record and applicable statutes, regulations and policies. The advisory opinion provided by HQMC memo 1610 MMRP-13/PERB dtd 2 Dec 15, was sent to you on 2 December 2015 for an opportunity to comment prior to being considered by the Board. A copy of this advisory opinion is again enclosed. Additionally, the Board considered your response to the Advisory Opinion dated 27 June 2016. After careful and conscientious consideration of the entire record, the Board found that the evidence submitted was insufficient to establish the existence ofprobable material error or injustice. In this connection, the Board substantially concurred with the comments contained in the advisory opinion. Additionally, upon review ofthe SNCO Academy BCP Data Sheet, the Board concluded that the measurements were annotated correctly. Per MCO 6110.3 paragraph 3.f.(5)(a), ifMarine exceeds weight on height/weight tables, height will be re-measured and recorded to the nearest 1/2 inch for use in body fat % estimation. As your weight of 215 pounds at the height of 72 inches exceeded the maximum of 202 pounds, your height was measured at the nearest 1/2 inch, per the SCNO Academy BCP Data Sheet, and therefore exceeded the allowed body fat percentage (height 71.5 inches, circumference value 20.5 = 20% body fat). Accordingly, your application has been denied. The names and votes ofthe members ofthe panel will be furnished upon request. It is regretted that the circumstances ofyour case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission ofnew and material evidence within one year from the date ofthe Board's decision. New evidence is evidence not previously considered by the Board prior to making its decision in your case. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence ofprobable material error or injustice.
