Pursuant to the provisions ofreference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (I) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner retired under FY96 Temporary Early Retirement Authority (TERA). 2. The Board, consisting of , reviewed Petitioner's allegations oferror and injustice on 28 June 2016 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence ofrecord. Documentary material considered by the Board consisted ofthe enclosures, naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice, finds as follows: Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. CONCLUSION Upon review and consideration of all the evidence ofrecord, the Board finds the existence of an injustice warranting the following corrective action. RECOMMENDATION: That Petitioner's naval record be corrected, where appropriate, to show that: a. The record ofdischarge from the U.S. Navy effective 13 December 1995 is rescinded. b. In accordance with NA VADMIN 240/94, Petitioner submitted an application for Temporary Early Retirement Authority (TERA) during the period of 19 December 1994 and 18 February 1995. Her request was received, processed, and approved by cognizant authority and became effective 13 December 1995. c. Note: Any Involuntary Separation Pay (ISP) previously received by the Petitioner will be deducted from Petitioner's retirement pay. No waiver will be granted. Furthermore, on 12 April 2004 the Department ofVeterans Affairs increased her disability rating from 30% to 70%. d. Defense Finance & Accounting Service (DFAS) will complete an audit ofPetitioner's records to determine if Petitioner is due any back pay and allowances. e. A copy ofthis Report ofProceedings will be filed in Petitioner's naval record . 4. It is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record ofthe Board's proceedings in the above entitled matter. 5. Pursuant to the delegation ofauthority set out in Section 6(e) of the revised Procedures of the Board for Correction ofNaval Records (32 Code ofFederal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority ofreference (a), has been approved by the Board on behalf ofthe Secretary of the Navy.
