Pursuant to the provisions ofreference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (I) with this Board requesting, in effect, that the applicable naval record be corrected to establish eligibility to transfer Post 9/11 GI Bill benefits to his dependents. 2. The Board, consisting of , reviewed Petitioner's allegations oferror and injustice on 11 August 2016 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted ofthe enclosures, naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department ofthe Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner's application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration ofall the evidence ofrecord, and especially in light of the contents ofenclosure (2), the Board finds the existence of an injustice warranting the following corrective action. RECOMMENDATION: That Petitioner's naval record be corrected, where appropriate, to show that: a. Petitioner elected to transfer unused educational benefits through the DMDC Transfer of Educational Benefits (TEB) web application on 30 November 2009 vice 2 December 2009. b. Petitioner, in coordination with his command, completed the Statement ofUnderstanding (SOU) and was submitted to Commandant ofthe Marine Corps (CMC) for inclusion in the Petitioner's Official Military Personnel File (OMPF). Petitioner volunteer for 3 years of obligated military service. c. CMC reviewed the Petitioner's TEB application, and it was approved on 30 November 2009. d. Upon completion ofthe above changes, Headquarters, United States Marine Corps (HQMC) will execute an approved Transferability ofEducational Benefits (TEB) application reflecting the transfer information. e. A copy ofthis Report of Proceedings will be filed in Petitioner's naval record. 4.
