Pursuant to the provisions ofreference (a), Petitioner's daughter, , filed enclosure (1) with this Board on behalf of her deceased father, a fonner Navy sailor, requesting that his Certificate of Release or Discharge from Active Duty (DD Form 214) be corrected to reflect he received the Purple Heart Medal. During the review ofPetitioner's record, it was detennined he was authorized the Combat Action Ribbon . Enclosures (1) through (3) apply. 2. The Board, consisting of reviewed Petitioner's allegations oferror and injustice on 17 August 2017 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, naval records, and applicable statutes, regulations, and policies. The Board also considered enclosure (3). 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department ofthe Navy. b. Although enclosure (l) was not filed in a timely manner, it is in the interest ofjustice to waive the statute of limitations and review the application on its merits. c. Per enclosure (3), Petitioner does not meet the criteria for the Purple Heart Medal. Petitioner's medical record was not available for review so NPC/PERS-312 and the Board were unable to determine if Petitioner's injury necessitated treatment by a Medical Officer at the time of injury which is a requirement for the Purple Heart Medal. d. Enclosure (3) states Petitioner is authorized the Combat Action Ribbon. Upon review and consideration of all the evidence of record, and especially in light of enclosure (3), the Board concludes that Petitioner's request wa1Tants partial favorable action. In view of the foregoing, the Board finds the existence ofan error warranting the following corrective action. RECOMMENDATION a. That Petitioner be issued a DD 215, Correction to Certificate of Release or Discharge from Active Duty, indicating the issuance of the Combat Action Ribbon. b. That a copy ofthis report of proceedings be filed in Petitioner's naval record. c. That, upon request, the Department of Veterans Affairs be infonned that Petitioner's application was received by the Board on 12 May 2016. 4. It is certified that a quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Board's proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) ofthe revised Procedures of the Board for Correction ofNaval Records (32 Code ofFederal Regulation, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
