Pursuant to the provisions ofreference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to Sea Duty Incentive Pay-Curtailment (SDIP-C). 2. The Board, consisting of , reviewed Petitioner's allegations of error and injustice on 13 June 2016 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted ofthe enclosures, naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner's application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light ofthe contents ofenclosure (2), the Board finds the existence of an injustice warranting the following corrective action. RECOMMENDATION: That Petitioner's naval record be corrected, where appropriate, to show that: a. Petitioner submitted a 1306/7 dated 4April 2014, approved by his commanding officer and then it was approved by higher cognizant authority, PERS-40, per BUPERS Millington message b. Petitioner is entitled to SDIP-C, at the lump sum amount minus taxes if applicable, at the rate of$900.00 per month for 9 months (number ofmonths Petitioner curtailed shore duty, Oct 2015 -Jul 2016) a total of$8,1000. The final amount to be determined by Defense Finance and Accounting Service (DFAS). c. Note: In accordance with the guidance ofPDM 008-13 dated 26 Apr 13, Petitioner must first contact his Personnel/Administrative Department and sign and date a written SDIP-C agreement NAVPERS 1070/613 (Page 13) before he can be paid the SDIP. Petitioner's Personnel/Administrative Department will forward a copy ofthe Page 13 to DFAS. d. A copy ofthis Report of Proceedings will be filed in Petitioner's naval record. 4. It is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record ofthe B the above entitled matter. 5.
