Pursuant to the provisions ofreference (a), Petitioner, an enlisted member ofthe Marine Corps, filed enclosure (1) to remove an Administrative Remarks (6105) entry dated 1 October 2014 from his Official Military Personnel File (OMPF). 2. The Board, consisting of reviewed Petitioner's allegations oferror and injustice on 3 March 2017, andpursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence ofrecord. Documentary material considered by the Board consisted ofthe enclosures, naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department ofthe Navy. b. Enclosure (1) was filed in a timely manner. c. Petitioner erroneously received an Administrative Remarks ( 6105) on 1 October 2014 per enclosure (3). The Administrativemarks (6105) was placed in the Petitioner OMPF pertained to, however, the entry was intended for a d. HQMC provided a favorable advisory opinion in response to the Petitioner's claim per enclosure (4). The advisory opinion concluded that the Administrative Remarks (6105) uploaded to the Petitioner's OMPF is erroneous since it belonged to another member. CONCLUSION: Upon review and consideration ofall the evidence of record, the Board concluded that Petitioner's request warrants relief in the form ofremoving from his record, the erroneous Administrative Remarks (6105) on 1 October 2014 per enclosure (3). In this regard, the Board found the advisory opinion furnished by Headquarters United States Marine Corps as a credible source for approval of Petitioner's claim. In view ofthe above, the Board directs the following corrective action. RECOMMENDATION: a. That Petitioner's naval record be corrected by removing the Administrative Remarks (6105) placed on 1October2014. b. That any material or entries inconsistent with or relating to the Board's recommendation be corrected from Petitioner's record and that no such entries or material be added to the record in the future. 4. It is certified that a quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record ofthe Board's proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction ofNaval Records (32 Code of Federal Regulation, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority ofreference (a), has been approved by the Board on behalf ofthe Secretary of the Navy.
