Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to authorize an entitlement to Basic Allowance for Housing (BAH) and Cost of Living Allowance (COLA) for his dependents location. 2. The Board, consisting of [NAMES REDACTED], reviewed Petitioner's allegations of error and injustice on 15 March 2017 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence ofrecord. Documentary material considered by the Board consisted ofthe enclosures, naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice, finds that prior to applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. CONCLUSION Upon review and consideration ofall the evidence of record, the Board finds the existence of an injustice warranting the following corrective action. RECOMMENDATION: That Petitioner's naval record be corrected, where appropriate, to show that: a. On 21 July 2010, Petitioner requested and was approved to continue to receive station allowances at his old permanent duty station (PDS) of [LOCATION] the dependents location, while he attended training enroute to his new PDS of [LOCATION]. Note: The Petitioner signed out of [LOCATION] on 21July2010, reported for training enroute from 1 August to 21August2010, and reported to his new PDS of [LOCATION] on 21 August2010. The Petitioner's spouse departed [LOCATION] on 16 September 2010. b. Petitioner is authorized to receive BAH at the Military Housing Area (MHA) [LOCATION] from 21 July 20 10 through 16 September 2010. c. Petitioner is authorized to receive COLA at the single rate (0) for the [LOCATION] from 21July2010 through 16 September 2010. d. A copy of this Report ofProceedings will be filed in Petitioner's naval record. 4. It is certified that quorum was present at the Board's review and deliberations, and that the the above entitled matter. 5.
