A three-member panel ofthe Board for Correction ofNaval Records, sitting in executive session, considered your application on 13 April 2017. Your allegations oferror and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings ofthis Board. Documentary material considered by the Board consisted ofyour application, together with all material submitted in support thereof, your naval record and applicable statutes, regulations and policies. The advisory opinion provided in NPC memo 1780 PERS-314 dated 23 February 2017 was sent to you on 13 March 2017 for an opportunity to comment prior to being considered by the Board. A copy ofthis advisory opinion is again enclosed. Your reply was received on 5 April 2017 and your case was presented to the Board. After careful and conscientious consideration of the entire record, the Board found that the evidence submitted was insufficient to establish the existence ofprobable material error or injustice. In this connection, the Board substantially concurred with the comments contained in the advisory opinion. The Board felt that you were sufficiently notified ofthe requirements involved in the successful transfer your education benefits, established in 38 U.S.C. §3319, NAVADMIN 203/09, and NAVADMIN 187/09. Accordingly, your application has been denied. The names and votes of the members of the panel will be furnished upon request. Regarding your request for a personal appearance, the Board determined that a personal appearance with or without counsel will not materially add to their understanding ofthe issue(s) involved. Therefore, the Board determined that a personal appearance was not necessary and considered your case based on the evidence ofrecord. It is regretted that the circumstances of your case are such that favorable action carmot be taken at this time. You are entitled to have the Board reconsider its decision upon the submission of new and material evidence. New evidence is evidence not previously considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction ofan official naval record, the burden is on the applicant to demonstrate the existence ofprobable material error or injustice.
