Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, fil ed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to be reimbursed her actual expenses for shipment ofhealth and comfort items. 2. The Board, consisting of [NAMES REDACTED], reviewed Petitioner's allegations oferror and injustice on 24 January 2017 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted ofthe enclosures, naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner' s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Departmerit ofthe Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner's application has commented to the effect that the request has merit and warrants partial favorable action. CONCLUSION Upon review and consideration ofall the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following partial corrective action. The Board believes the Petitioner should have been reimbursed for qualifying articles that were shipped but at the government rate. That Petitioner' s naval record be corrected, where appropriate, to show that: a. The Petitioner's reimbursable shipped total weight at government expense is changed from "239 pounds" to "265 pounds 11.5 ounces" from [REDACTED] to [REDACTED]. Note: The Petitioner was reimbursed for 239 pounds at the government rate for a total of $292.66. b. Credit ofthe weight ofHouse Hold Goods (HHG) is to be settled against the line of accounting on the Petitioner's demobilization orders. c. The Petitioner is to resubmit the Personally Procured Move (PPM) claim and a copy ofthe Board for Correction ofNaval Records (BCNR) approval letter to the Navy Household Goods Audit Team (HHG-AT) for re-adjudication. d. In so far as Petitioner's request for corrective action that exceeds the foregoing, the Board concurred with the advisory opinion. The Board agreed that the Petitioner not be reimbursed for the total cost for the shipment ofthe HHG items shipped at the commercial rate. e. A copy ofthis Report of Proceedings will be filed in Petitioner' s naval record. 4. It is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Board's record· 5. Pursuant to the delegation of authority set out in tio ofthe revised Procedures of the Board for Correction ofNaval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
