The advisory opinion provided in HQMC memo 1610 MMRP­ 13/PERB dated 4 January 2016 was sent to you on 4 January 2016 for an opportunity to comment prior to being considered by the Board. After careful and conscientious consideration of the entire record, the Board found that the evidence submitted was insufficient to establish the existence ofprobable material error or injustice. In this connection, the Board substantially concurred with the comments contained in the advisory opinion. The Board noted that a month prior to taking the PFT you saw your primary care physician regarding your knee problem where at that time you should have immediately requested to be on light duty status. The Board noted that you acknowledged the report, and wrote a statement taking full responsibility for your actions. Accordingly, your application has been denied. It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new evidence within one year from the date ofthe Board's decision. New evidence is evidence not previously considered by the Board prior to making its decision in this case.
