Pursuant to the provisions ofreference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to receive back pay and all allowances entitled. 2. The Board, consisting of , reviewed Petitioner's allegations oferror and injustice on 14 June 2016 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence ofrecord. Documentary material considered by the Board consisted of the enclosures, naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. CONCLUSION Upon review and consideration ofall the evidence ofrecord, the Board finds the existence of an injustice warranting the following corrective action. RECOMMENDATION: That Petitioner's naval record be corrected, where appropriate, to show that: a. The Petitioner executed a request for conditional release (DD Form 368) on 31 October 1995. Furthermore, the request for conditional release to enlist/appoint Petitioner into the U.S. Navy was received and approved by cognizant authority. b. The Enlistment/Reenlistment Document Armed Forces ofthe United States (DD Form 4), executed in the United States Navy is modified to read block 5 (Date of enlistment reenlistment) "27 November 1995" vice "31 October 1995". c. This change will adjust Petitioner's Pay Entry Base Date (PEBD) to reflect 23 June 1992 vice 19 July 1992. d. Defense Finance & Accounting Service (DFAS) will complete an audit ofPetitioner's records to determine if Petitioner is due any back pay and allowances. e. A copy ofthis Report of Proceedings will be filed in Petitioner's naval record. 4. It is certified that a quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the matter. 5. Pursuant to the delegation of authority set out in Sectio e revised Procedures ofthe Board for Correction ofNaval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
