Pursuant to the provisions ofreference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to be transferred to the retired reserves awaiting pay at age 60. 2. The Board, consisting of , reviewed Petitioner's allegations oferror and injustice on 13 February 2018 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted ofthe enclosures, naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice, finds as follows: Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. CONCLUSION Upon review and consideration ofall the evidence ofrecord, the Petitioner reached his Reserve end ofcurrent contract (which occured on 12 December 2017) and was discharged prior to submitting his retirement request. The Board finds the existence of an injustice warranting the following corrective action. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: The Petitioner's discharge dated 12 December 2017 is rescinded. The Petitioner submitted to be transferred to the retired reserve awaiting pay at age 60 and it was approved by cognizant authority prior to 30 November 2017. The Petitioner was transferred to the retired reserve awaiting pay at age 60 effective 30 November 2017 with 21 years of qualifying service towards a reserve retirement. Note: the Petitioner met the two years' time in grade requirement to retire in the rank of A copy ofthis Report ofProceedings will be filed in Petitioner's naval record. 4.
