Pursuant to the provisions ofreference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be con;ected to show he enlisted in paygrade E-3. I 2. The Board, consisting of , reviewed Petitioner's allegations oferror and injustice on 26 May 2017 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted ofthe enclosures, naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pe1taining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department ofthe Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner's application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration ofall the evidence ofrecord, and especially in light ofthe contents ofenclosure (2), the Board finds the existence of an injustice warranting the following corrective action. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: Petitioner was enlisted in paygrade E-3, effective l December 2014 (Active Duty Service Date). Petitioner met the advanced paygrade criteria based on college credits. Note: Petitioner was reduced to E-2 via Non-Judicial Punishment on 28 May 2015. Petitioner was advanced to paygrade E-3, effective 16 March 2016 Note: the change in the effective date of advancement to E-3 may also impact on Petitioner's E­4 advancement opportunity. IfPetitioner was eligible for, but did not take an E-4 examination because the above change had not yet been made, the following procedures will apply to remediate that missed opportunity. Petitioner should take the next available E-4 advancement examination. Once Petitioner receives the next profile sheet, Petitioner may reapply to this Board for consideration of advancement to E-4 retroactive to the date Petitioner would have been advanced on the "missed" examination cycle(s). Petitioner should then submit a copy of the worksheet for missed 9ycle(s). In addition, Petitioner should submit a DD Fo~n 149, command endorsement/recommendation, and must include a copy of this letter with the request. The Board will then determine whether the request will be approved. A copy of this Report of Proceedings will be filed in Petitioner's naval record. 4. It is certified that a quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Boar 's proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6( e) of the revised Procedures of the Board for Correction ofNaval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
