Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (I) with this Board requesting, in effect, that the applicable naval record be corrected to receive his previous Permanent Duty Station (PDS) Basic Allowance for Housing (BAH) rate. 2. The Board, consisting of , reviewed Petitioner's allegations oferror and injustice on 6 June 20 L7 and, pursuant to its regulations, detennined that the corrective action indicated below should be taken on the available evidence ofrecord. Documentary material considered by the Board consisted ofthe enclosures, naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice, finds as follows: Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. CONCLUSION Upon review and consideration of all the evidence of record, the Board believes the Petitioner, prior to his transfer, received from his detailer verbal confirmation that the request would be authorized. However, due to an administrative oversight, the request for close proximity move was not submitted in a timely manner. The Board finds the existence of an injustice warranting the following corrective action. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: Petitioner received BUPERS Order 2246 modification, on or about 29 September 2016, stating the following: "Per your request, this order is issued with no entitlement or funding for relocation of dependents or movement of household goods. If you receive approval for BAH at the previous duty station, you will forfeit the authorization for all travel and transportation allowances for the entire assignment per NAV ADM IN IOIII0." Petitioner is authorized Basic Allowance for Housing (BAH) with dependents at the rate from 3 October 2016 to present. A copy of this Report of Proceedings will be filed in Petitioner's naval record. 4. It is certified that a quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record ofthe Board's proceedings in the above entitled matter. 5.
