Pursuant to the provisions ofreference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to receive your full retirement pay. 2. The Board, consisting of , reviewed Petitioner's allegations oferror and injustice on 7 March 2017 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted ofthe enclosures, naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. The Petitioner joined the Navy on 9 November 1964 and was discharged on 12 July 1974. After a short break in service, the Petitioner joined the Navy Reserves on 16 February 1975 and retired on 30 September 1994. On 6 April 1995, the Petitioner received his Notification of Eligibility (NOE). The Petitioner submitted a request to the Navy Personnel Command (NPC) for retirement pay for non-regular service and it was approved on 4 December 2014 with an effective date ofeligibility of 16 January 2002. CONCLUSION Upon review and consideration ofall the evidence of record, the Board finds the existence of an injustice warranting the following corrective action. RECOMMENDATION: That Petitioner's naval record be corrected, where appropriate, to show that: a. The Petitioner submitted a request to NPC: for his retired pay for non-regular service on or before 16 January 2002 and it was approved by competent authority effective "16 January 2002" vice "4 December 2014". b. A copy of this Report of Proceedings will be filed in Petitioner' s naval record. 4. It is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Board procedings in he above entitled matter. 5.
