Pursuant to the provisions of reference (a) Subject, hereinafter referred to as P_etitioner, filed enclosure (I) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to retroactive Physician Board Certification Pay (BCP) and Medical Additional Special Pay (ASP). 2. The Board, consisting of reviewed Petitioner's allegations oferror and injustice on 25 August 2017 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence ofrecord. Documentary material considered by the Board consisted ofthe enclosures, naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department ofthe Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner's application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration ofall the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. Petitioner was eligible for Physician BCP and Medical ASP; the payments were not processed as a result ofher pay account reflecting release from active duty on 31 December 2016, however was actually released from active duty effective 31 January 2017. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: The Petitioner submitted Physician BCP and Medical ASP incentive requests in a timely manner, in accordance with OPNAVINST 7220.17. Furthermore, the request was received and approved by cognizant authority. This change will entitle Petitioner to Physician BCP incentive, at the annual rate of $6,000 and Medical ASP incentive, at the annual rate of$15,000 retroactive from 1January2017 through 31 January 2017. A copy ofthis Report of Proceedings will be filed in Petitioner's naval record. 4. It is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Board procedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Se the revised Procedures of the Board for Correction ofNaval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority ofreference (a), has been approved by the Board on behalf ofthe Secretary of the Navy.
