A three-member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 13 September 2017. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted ofyour application, together with all material submitted in support thereof, relevant portions ofyour naval record and applicable statutes, regulations, and policies. The Board also reviewed the advisory opinion (AO) provided by Navy Personnel Command (PERS-32) dated 12 June 2017, which was previously provided to you. The Board carefully considered your desire to remove or reevaluate the evaluation reports for the reporting periods 27 May 2015 to 15 November 2015 and 16 November 2015 to 15 November 2016. The Board considered your contentions that you did not fail your Physical Fitness Assessment, that you were unfairly graded on your 2016 evaluation, and that your chain ofcommand has expressed their dislike in you and have taken steps to evaluate you unprofessionally. The Board concluded that theremoval or reevaluation ofthe contested evaluation reports is not warranted. In this regard, the Board substantially concurred with the comments and recommendation contained in the AO. Accordingly, your application has been denied. It is regretted that the circumstances ofyour case are such that favorable action cannot be taken at this time. You are entitled to have the Board reconsider its decision upon the submission of new and material evidence. New evidence is evidence not previously considered by the Board. In this regard, it is important to keep in mind that a presumption ofregularity attaches to all official records. Consequently, when applying for a correction ofan official naval record, the burden is on the applicant to demonstrate the existence ofprobable material error or injustice.
