A three-member panel ofthe Board for Correction ofNaval Records, sitting in executive session, considered your application on 27 October 2017. Your allegations oferror and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings ofthis Board. Documentary material considered by the Board consisted ofyour application, together with all material submitted in support thereof, relevant portions of your naval record, and applicable statutes, regulations, and policies. Additionally, the Board considered the advisory opinion(AO) provided by Headquarters, Marine Corps (MMRP-13/PERB) dated a copy ofwhich was previously sent to you. See enclosure. After careful and conscientious consideration of the entire record, the Board found the evidence submitted was insufficient to establish the existence ofprobable material error or injustice to warrant the requested modifications to your fitness report covering to The Board considered the justification provided by the Reporting Senior (RS) stating he inadvertently marked the attributes ofcourage, initiative, and communication skills incorrectly. The Board substantially concurred with the AO. Per MCO 1610.7F, "the Commandant ofthe Marine Corps can approve a revised assessment ofa Marine's conduct or performance based entirely on facts about the Marine that were unknown when the original report was prepared." The RS did not provide any specifics on what he overlooked about your performance or what he was not aware ofat the time ofthe report. Additionally, there is no indication the Reviewing Officer (RO), who concurred with the marks and affirmed the overall validity, was contacted to request his support for the upgrades. Accordingly, your application has been denied. It is regretted that the circumstances ofyour case are such that favorable action cannot be taken at this time. You are entitled to have the Board reconsider its decision upon the submission of new and material evidence. New evidence is evidence not previously considered by the Board. In this regard, it is important to keep in mind that a presumption ofregularity attaches to all official records. Consequently, when applying for a correction ofan official naval record, the burden is on the applicant to demonstrate the existence ofprobable material error or injustice.
