Pursuant to the provisions of the reference, Petitioner, an enlisted member ofthe Marine Corps Reserve, filed enclosure (1) with this Board requesting removal from her official military personnel file (OMPF) the Adminishˇative Remarks (Page 11) entry issued on 12 August 2005. Enclosures (1) and (2) apply. 2. The Board, consisting of , reviewed Petitioner's allegations of error and injustice on 23 June 2017, and pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although enclosure (1) was not filed in a timely manner, it is in the interest ofjustice to waive the statute of limitations and review the application on its merits. c. On 12 August 2005, Petitioner received a Page 11 counseling entry documenting her disobedience of a lawful order. Although the entry was acknowledged by the Petitioner, it was not authenticated by the Commanding officer, as required by Marine Corps regulations. d. Petitioner contended that the Page 11 entry is unjust because it was not signed by the Commanding Officer and was instead left blank. CONCLUSION Upon review and consideration of all the evidence of record, the Board concluded that Petitioner's request warrants relief. In this regard, the Board determined that the Page 11 entry was not properly issued and authenticated by her Commanding Officer, as required by Marine Corps regulations. In view ofthe foregoing, the Board finds the existence ofan injustice warranting the following corrective action. RECOMMENDATION. Petitioner's naval record be corrected by removing the Page 11 entry, dated 12 August 2005, regarding her disobedience ofa lawful order. That any material or entries inconsistent with or relating to the Board's recommendation be corrected, removed or completely expunged from Petitioner' s record and that no such entries or material be added to the record in the future. That no further relief be granted. 4. It is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Board procedings in the above entitled matter. 5. Pursuant to the delegation ofauthority set out in Section 6( e) of the revised Procedures of the Board for Correction ofNaval Records (32 Code of Federal Regulation, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
