Although your application was not filed in a timely manner, the Board found it in the interest of justice to waive the statute of limitations and consider your application on its merits. A threemember panel ofthe Board for Correction ofNaval Records, sitting in executive session, considered your application on 1 May 2017. The names and votes ofthe members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings ofthis Board. Documentary material considered by the Board consisted ofyour application, together with all material submitted in support thereof, your naval record, and applicable statutes, regulations, and policies. You enlisted in the Navy on 5 August 1944, and began a period ofactive duty on 29 August 1944. You served honorably until your discharge on 10 July 1946. You were discharged from the Navy in the rank ofthird class petty officer (Machinist Mate Third Class/MM3), on 10 July 1946, with an honorable characterization of service. After careful and conscientious consideration of the entire record, The Board found the evidence submitted was insufficient to establish the existence ofprobable material or injustice. The Board considered your request for a change to your rank from petty officer third class to second class petty officer (MM2). When making its determination, the Board noted that you state you successfully completed the required exams and qualified for promotion to the rank of petty officer second class prior to your discharge. The Board, in its review ofyour entire record and application, carefully weighed all factors and noted that although you may have completed the requirements for eligibility for promotion to second class petty officer, your record does not reflect that you were advanced to the higher grade. The Board noted that eligibility for promotion and advancement to the higher grade are distinct from one another. The Board found that absent information in your record that you were promoted to the grade of second class petty officer, your application does not merit correction. Accordingly, your application has been denied. It is regretted that the circumstances of your case are such that favorable action cannot be taken at this time. You are entitled to have the Board reconsider its decision upon the submission of new and material evidence. New evidence is evidence not previously considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence ofprobable material error or injustice.
