A three-member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 28 June 2017. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, your naval record, and applicable statutes, regulations, and policies. In addition, the Board considered the advisory opinions furnished by Headquarters, Marine Corps (MMRP-13/PERB) dated 7 March 2017, which was previously provided to you. After careful and conscientious consideration of the entire record, the Board found the evidence submitted was insufficient to establish the existence of probable material error or injustice. In this regard, the Board substantially concurred with the comments contained in the advisory opinion. Specifically, in regards to the fitness report covering the period from 20140530 to 20141027, Marine Corps directives instructs Reporting Seniors (RS), in marking the 14 attributes to review the descriptors thoroughly and determine the position on the scale that best reflects the performance or behavior of the Marine Reported On during the evaluation period. Your submission does not add support any changes to the attributes. Additionally, you provided no endorsement from the Reporting Officer for the revised cumulative relative value. Regarding the fitness report covering the period from 2015070 I to 20151231, the fact that you fell in the bottom 1/3 of the RS 's profile for sergeant Fitreps does not denote unsatisfactory perfonnance. The Board concurred with the advisory opinion that the contested reports should remain in your Official Military Personnel File, and were administratively and procedurally correct as written and filed. Accordingly, your application has been denied. It is regretted that the circumstances of your case are such that favorable action cannot be taken at this time. You are entitled to have the Board reconsider its decision upon the submission of new and material evidence. New evidence is evidence not previously considered by the Board. In this regard, it is important to keep in mind that a presumption ofregularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.
