After careful and conscientious consideration of the entire record, the Board found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board of Corrections of Naval Records, sitting in exective session, considered your application on 8 January 2019. The names and votes of the members of the panel will be furnished upon request. Your allegatios of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support therof, relevant portions of your naval record and applicable statutes, regulations and policies. In addition, the Board considered the advisory opinion contained in Commander, Navy Personnel Command (NPC) memorandum 1430 PERS 8031/025 of 8 February 2018; a copy of which was previously provided to you for comment. A copy of his advisory opinion is against enclosed. In August 2016, you participated in the August 2016 Cycle 099 Navy Wide Advancement Examination (NWAE) in the rate of AS and Passed Not Advanced (PNA). On 4 November 2016, NAVADMIN 247/16 announced the elimination of the reserve component Navy Occupational Specialties (NOS)...A430 (formerly AS)...effective 1 November 2016. On 11 January 2017, your request for Career Waypoints (C-WAY) was approved-pending. On 3 March 2017, your C-WAY was approved-executed. In August 2017, you participated in the August 2017 Cycle 101 NWAE in the EA rate and failed. In February 2018, you participated in the February 2018 Cycle 102 NWAE in the EA rate and failed. You requested to compare one exam against another for missed Cycle 100. The Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. Nevertheless, the Board concluded that you provided no evidence to support your claim that you were not able to take the February 2017 Cycle 100 due to no fault of your own. The Board does not entirely agree with the Advisory Opinion when they stated "He should be taking the AS 1 NW AE prior to completing all requirements for conversion into the EA rating" because in accordance NAV ADMIN 247/16, the last available NWAE for E-6 in the rating of AS was Cycle 099 in August 2016. The Board agreed that your Cycle 099 cannot be graded against the missed Cycle 100 due to the deletion of the AS rating. The Board agreed that your Cycle 101 could not be graded against the missed Cycle 100 due to you failing Cycle 101. In this connection, the Board substantially concurred with the comments contained in the advisory opinion. It is regretted that the circumstances of your case are such that favorable action cannot be taken at this time. You are entitled to have the Board reconsider its decision upon the submission of new and material evidence. New evidence is evidence not previously considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice. Executive Director
