Pursuant to the provisions of reference (a), Petitioner, an filed enclosure (1) with this Board requesting the removal of his Administrative Remarks (Page 11/6105) counseling entry dated with rebuttal statement, from his Official Military Personnel File (OMPF). 2. The Board, consisting of reviewed Petitioner's allegations oferror and injustice on 15 November 2017, and pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted ofthe enclosures, relevant portions of Petitioner's naval records, and applicable statutes, regulations and policies. Enclosures (1) and (2) apply. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department ofthe Navy. b. Enclosure (2) states in part, that the Petitioner was counseled concerning his violation of Article 107 (False Official Statement) ofthe UCMJ, in that he passed false accountability reports during the early morning hours of . Upon conclusion oftraining at MWTC he failed to supervise sights counts conducted by his squad leaders and not visually and/or physically check all serialized equipment turned into the armory. c. Petitioner contends that his parent command corrected the paperwork to reflect the outcome ofthe incident from as a Page 11 rather than a 6105 due to Officers should not receive a 6105. Petitioner also contends the Page 11 is properly uploaded in his OMPF. CONCLUSION: Upon review and consideration of all the evidence of record, the Board concluded that Petitioner's request warrants favorable action. In reaching its conclusion, the Board after careful consideration ofthe Petitioner's record, concluded that the Page 11/6105 counseling was inappropriately issued to the Petitioner and was not written in accordance with Marine Corps directives, and therefore the removal ofthe Page 11/6105 counseling dated shall be granted. In view ofthe foregoing, the Board recommends the following corrective action: RECOMMENDATION: The Petitioner's naval record be corrected by removing his Page 11 counseling entry dated from his OMPF. No further relief be granted. 4. It is certified that a quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record ofthe Board's proceedings in the above entitled matter. 5. Pursuant to the delegation ofauthority set out in Section 6(e) ofthe revised Procedures ofthe Board for Correction ofNaval Records (32 Code of Federal Regulation, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf ofthe Secretary ofthe Navy.
