Pursuant to the provisions ofreference (a), Petitioner, an enlisted member ofthe Marine Corps, filed enclosure (1) with this Board requesting the removal ofan Administrative Remarks (Page 11) 6105 counseling entry dated 8 August 2017, from his Official Military Personnel File (OMPF). 2. The Board, consisting of reviewed the Petitioner's allegations oferror and injustice on 17 January 2018, and pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence ofrecord. Documentary material considered by the Board consisted ofthe Petitioner's application, together with all material submitted in support thereof, relevant portions ofthe Petitioner's naval record and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department ofthe Navy. b. On 8 August 2017, the Petitioner signed a Page 11 counseling which stated in part, that he was being counseled concerning his violation ofArticle 86 (absence without leave) and Article 92 (failure to obey order, regulation) ofthe Uniform Code ofMilitary Justice. See enclosure (2). c. Enclosure (3), a letter from Petitioner's Commanding Officer and the issuing officer ofthe contested Page 11 entry, stated in part that the Page I 1 entry is an administrative error, and he requested that the Page 11 be removed from the Petitioner's OMPF. CONCLUSION Upon review and consideration ofall the evidence ofrecord and in light ofenclosure (3), the Board concluded that there is an error in the record and the Petitioner's request warrants favorable action. In this regard, the Board substantially concurred with the comments contained in enclosure (3) and directs the removal ofenclosure (2) from the Petitioner's OMPF. RECOMMENDATION: In view ofthe above, the Board directs the following corrective action. Petitioner's naval record be corrected by removing enC!osure (2) from his OMPF. 4. It is certified that a quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record ofthe Board's proceedings in the above entitled matter. 5. Pursuant to the delegation ofauthority set out in Section 6(e) ofthe revised Procedures ofthe Board for Correction ofNaval Records (32 Code ofFederal Regulation, Sectiori 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority ofreference (a), has been approved by the Board on behalf ofthe Secretary ofthe Navy.
