Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner received relief in the adjustment of reenlistment contract to qualify for Selective Reenlistment Bonus (SRB) and Early Reenlistment Kicker upon completion of training. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 31 March 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 5 July 2016, Petitioner arrived to Drill Instructor School. c. On 31 August 2017, MARADMIN 491/17 (Retraining guidance on FY18 MOS manual changes for the communications (06XX) occupational field) was published and stated that on 1 October 2017, Marines possessing the MOS of 0612, 0619, 0651, 0659, 2821 and 2823 are reclassified as outlined in refs (a) and (d). d. On 1 November 2017, Petitioner was promoted to Staff Sergeant/E-6 and was assigned a primary occupational specialties (PMOS) of 0631. e. On 13 July 2018, Petitioner’ Reenlistment, Extension, Lateral Move (RELM) request was submitted, and approved by Headquarters, U.S. Marine Corps on 16 July 2018. f. On 21 July 2018, Petitioner reenlisted for 4 years as a 0631. g. On 1 October 2019, Petitioner transferred from Drill Instructor,, . h. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that while Petitioner was on drill instructor duty, MARADMIN 491/17 was published reclassifying his MOS to 0631; however, when he reenlisted as a Staff Sergeant, a bonus was only available for 0639. To be assigned to this MOS, Petitioner needed supplemental training by attending his respective chief course at the formal learning center. Petitioner could not complete the training while on drill instructor duty; however, once he completes the training, he will be eligible to receive the bonus. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was awarded upon completion of MOS training a zone “B” SRB for MOS 0639, which is capped at $30,000 for 48 months of additional obligated service. Remaining obligated service to 18 July 2019 will be deducted from SRB computation. Furthermore, Petitioner is entitled to an Early Reenlistment Kicker payment of $10,000 upon submitting his reenlistment request between 5 July 2018 and 30 September 2018. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
